Our Standard Terms and Conditions

Managed Hosting

We only host sites that we believe are lawful, we do not accept hosting for any sites that are offensive in nature. It is at our sole discretion as to what we believe is offensive or unlawful.

Your Obligations

• You will not, nor will you permit or authorise any other person to post, present or link to any material which is abusive, unlawful, threatening, defamatory, obscene, pornographic, screen scraping or that to what would otherwise be objectionable in any way.
• You will not post or have the site host any material containing malicious code or viruses, even if these are inactive.
• You will keep all information provided by us to access your hosting environment, secure including usernames, passwords and any other identifiable information that could enable a security breach.
• You will notify us immediately if there is any potential or known security risk from unauthorised access to any of the details related to hosting or managing your hosting environment.
• You will make us aware of any potential changes that you plan or have made to your site that would increase traffic, or risk causing an overload based on your managed hosting plan or could cause detrimental services to our other customers.
• You have and will continue to have adequate insurance cover in respect to any loss of data or damage to data that is stored on our servers. Friendlyhost, its staff or representatives, have no liability for any loss or damage to any data stored on our servers.
• You will abide by all applicable legislation, our terms and conditions, our acceptable use policy, and in a secure and honest manner.
• You will ensure that all invoices received by us for your managed hosting or approved services, will be paid on time as stated on the invoice. If payments for invoices are not received within 30 days past their due date, then we will attempt to recover the cost as stated on the invoice by means of a debt collection agency. You will be liable for all and any collection costs incurred during the collection process.
• You accept and agree that Friendlyhost may alter and have the right to modify our terms and conditions at any time and without notice.

Our Obligations

• We will ensure that any suspected harmful use or misuse will be discussed with you if it effects your hosting environment. We may and have the right to disable (without notice) any services offered to you that do not meet out terms and conditions or if we believe that it is in the best interests of you or our other clients.
• We will use every reasonable endeavour at all times, to make the hosting server and the applicable services available to you, but we shall not, in any event, be liable for interruptions of services or down-time of the server. All cases will be assessed on an individual basis. After we ascertain the cause of any interruptions, we will then refund in part or in full any hosting fees that were paid during the time of the disruption as we see fit and at our own discretion.

Intellectual Property

• You have obtained all necessary and lawful intellectual consents or clearances for all material and content provided on your website as well as the legal use of your domain name. You agree that Friendlyhost, its staff or representatives, have no liability for any loss or damage caused due to your misuse of copyright material.
• You retain all intellectual property ownership that belongs to you, this does not transfer to Friendlyhost in any way or form.

Indemnity

• You will indemnify Friendlyhost, its staff or representatives and keep us indemnified from any breaches by you of these terms as well as any claim brought against us by a third party resulting from the use and provisioning of our services to you, as well as your use of our server without limitation on all claims, proceedings, actions, liabilities, losses, damages, costs or expenses, including all legal costs and expenses, no matter how they are/were incurred by us due to your breach of this agreement. Our total combined liability to you for any claim, arising out of the provision of the services or in connection with, shall be limited to the fees paid by you in respect of the total services, which are the subject of any such claim.

Term of Services

• All services offered are on a monthly subscription service and billed quarterly. Should you wish to cancel your contract, you must give at least 30 days notice subject to the end of the current monthly term. Your account will then be suspended on the last day of month which falls at the end of the 30 days notice. Any paid fees for hosting past that 30 days will then be refunded for any unused portion of the subscription.
• Notice of cancellation by either party must be done so in writing, by way of email or letter.
